General Terms and Conditions of Sale – Maddies
The present general terms and conditions of sale (hereinafter "GTC") govern the contractual relations between Maddies, a cake design studio established in Belgium, and any natural or legal person (hereinafter "the Client") placing an order.
By confirming an order, the Client acknowledges having read and unreservedly accepted these GTC.
1. Purpose
Maddies designs, produces, and delivers personalized sweet creations (cakes, tiered cakes, pastries, accompanying decorations).
Since each product is made to order, these GTC apply to all orders, whether collected at the studio or delivered.
2. Orders and Deadlines
- Personalized cake (1 tier): order at least 2 weeks before pickup or delivery date.
- Personalized cakes (2 tiers): at least 3 weeks.
- Personalized cakes / Wedding cakes (> 2 tiers): at least 3 months.
Orders must be confirmed no later than Sunday for the following week.
Urgent requests ("SOS cake") may be accepted depending on the studio’s availability.
All orders are binding and final once the deposit has been received as stated in the quotation or on the website.
3. Prices and Payment Terms
Prices listed on the website are in euros, VAT included.
The final price varies depending on customization options (size, flavor, colors, decorations).
Accessories (flowers, toppers, candles, etc.) are charged separately.
Tiered cakes, wedding cakes, and special constructions require a personalized quotation.
An order is only confirmed after payment of a non-refundable deposit.
The balance must be paid at pickup or upon delivery.
4. Pickup and Delivery
Pickup at the studio (free of charge):
The Client collects the order on the agreed date and time.
Any delay exceeding 15 minutes may incur a fee of €15 per started hour, except in cases of force majeure.
Delivery:
Delivery is only possible in Brussels and surrounding municipalities.
Costs are communicated at the time of order depending on the zone.
An indicative delivery window is provided at least 48 hours in advance by email.
Deliveries outside Brussels may be considered upon prior request and explicit approval by Maddies.
Maddies undertakes to transport every creation with the utmost care. Liability, however, ceases once the order has been handed over to the Client.
5. Transfer of Risk and Liability
From the moment of pickup or delivery, Maddies is no longer responsible.
Damage caused by transportation by the Client or improper storage cannot be attributed to Maddies.
A transportation and storage guide is provided or available upon request.
6. Cancellation, Postponement, and Refunds
- Cancellation: regardless of the reason, no right to a refund.
- Postponement: possible if Maddies is notified at least 3 weeks in advance and subject to availability.
- Refunds: deposits or confirmed orders are non-refundable due to the perishable and personalized nature of the products.
- **Exchanges:** not possible due to the custom nature of the creations.
7. Complaints
All complaints must be submitted in writing (via e-mail) within 24 hours after delivery or pickup.
After this period, no complaints will be accepted.
8. Intellectual Property
All creations, recipes, images, photographs, and communication material from Maddies are protected by intellectual property rights.
Any reproduction or use without prior written authorization is strictly prohibited.
9. Personal Data
Maddies processes Client data in accordance with the General Data Protection Regulation (GDPR).
The collected information is used exclusively for order processing and will never be disclosed to third parties without consent.
10. Governing Law and Jurisdiction
These GTC are subject to Belgian law.
In case of a dispute, and failing an amicable settlement, the courts of the judicial district of Maddies’ registered office shall have exclusive jurisdiction.
11. Storage and Transport Advice
To ensure quality and food safety, the Client undertakes to respect the following recommendations:
- transport the cake on a flat and stable surface (car trunk or floor)
- never place the cake on a lap or car seat
- keep the vehicle cool and avoid exposure to sunlight
- always lift the cake from its base
- drive carefully to avoid shocks
